Is Apollo doing ok finacially?

I just recieved my order of 10 new scrolls from them and there was no gum!

Sorry Keith's been really busy sending me swag and has been slacking on the gum. I have to get a picture of me in my Apollo hat and shirt in front of my right arm.
 
My local dealer has admitted to removing the gum from the packages from Apollo before giving the gear to the purchaser...

Well, THAT would end my relationship with that dealer.:)

Still not as bad as a company where I used to work when we would remove the clamp, safety cable, and colorframe, and sell them separately, even though <manufacturer deleted> included them with the fixtures.

Funny, my order came in last night with gum and a gel pen! Although I did have it drop shipped direct from our friends at Apollo.

I think morally it's wrong; the legality of it depends on the contract between the dealer and the manufacture if I'm not mistaken.

Eh, I wouldn't even call it immoral, the store buys the fixtures and then it is up to them to resell them. Free market will determine if they can get away with not bundling the accessories when their competition does for the same price.
 
I think it would be illegal if they say they are going to give you x,y,and z in a package and then you only get x and not y and z. That would be false advertising...

Not exactly true...As a hardware store owner if I buy a bunch of dewalt screw guns from my supplier then pull the batteries from the package and sell it to you..that's illeagal. And its also a god way to have Dewalt sue me as well as stop selling to me.
 
To my knowledge thought they don't advertise that they are sending gum too, it just happens to come with as a bonus

His comment wasn't in reference to the gum my friend...but the place Derek used to work at.
 
I noticed when researching lighting instrument prices that some internet dealers change what is included in the box. While it's nasty, I don't see why it would be illegal if you clearly advertise that the C-clamp, color frame, and safety cable are extra. Now the guys in Middleton may decide to cut off your supply, that's a chance these businesses take. But unless there is a contract that say,s "as a dealer you must sell everything as it is in the box". It's no illegal.

Taking the gum, although petty, is even less of a crime because it's a bonus that Apollo throws in. You purchased gel you got gel. If the swag gum disappears, it was never paid for or even promised. Does it suggest that you should consider doing business with someone else? Definitely. If they'll take your gum what else will they do?

If I'm buying a brand new S4 19 the product's description says that a C-clamp and a gel frame are included.

If the seller is quoting you brand new S4's and they are pulling the C-clamp and the gel frame they are guilty of 1) false advertising 2)mis-representation 3)technically fraud.

I'm of course not a legal expert at all... My feeling is if they tell you that the C-clamp and gel frame is extra in their ad. I don't think they are guilty of anything legally. Are they sleazy? Yes. Will the guys in Middleton get mad and pull their product? They certainly have the right. I don't think there's anything illegal unless they have a contract with the manufacturer that says you must include everything.
